Warranty & Legal Guarantee

Introduction & Short Information on Legal Guarantee and Manufacturer Warranty

All Bestway products are subject to statutory consumer warranty rights as well as – for selected product groups – a voluntary Bestway manufacturer’s warranty.

  • Statutory Legal Guarantee (24 months): In the event of a product defect, consumers must always contact the retailer from whom the product was purchased. Only the retailer is responsible for handling statutory warranty claims.
  • Bestway Manufacturer Warranty: For certain product categories (see below), Bestway also offers an additional voluntary manufacturer warranty. This warranty is handled directly through Bestway customer service.

Important: The online complaint form at bestwayservice.de is intended exclusively for the voluntary Bestway manufacturer warranty. The delivery of replacement parts takes place within the framework of the voluntary manufacturer warranty and does not affect statutory consumer rights. For claims under the statutory legal guarantee, please contact the retailer from whom you purchased the product.

If you describe a defect in the form, we will check whether a claim under the manufacturer warranty exists. If your request instead falls under the statutory legal guarantee, we will inform you accordingly.

Warranty Conditions

Below you will find the warranty conditions applied by BESTWAY EUROPE S.p.A., headquartered at Via della Resistenza No. 5, San Giuliano Milanese (20098) – Milan, Italy (hereinafter referred to as “BESTWAY”), for products sold within the European Economic Area under the BESTWAY brand.

1. Statutory Legal Guarantee

1.1 The statutory legal guarantee is provided under European Directive 2019/771/EC, which aims to protect consumers, as defined below, in the event of a lack of conformity of purchased goods (“Products”).

1.2 According to the above-mentioned European Directive, a consumer is any natural person who purchases a product for purposes that are outside their trade, business, craft, or professional activity (the “Consumer”).

1.3 The statutory legal guarantee period is 24 months from the delivery of the goods to the consumer. Please note that the provisions defined in the above directive do not apply outside the countries of the European Economic Area, where the relevant local legislation applies.

1.4 If the consumer believes that they have purchased a product with a lack of conformity, they must contact their retailer in order to exercise the statutory legal guarantee.

1.5 BESTWAY assumes responsibility for possible conformity defects of the products for any consumer who purchased the products directly from BESTWAY itself.

2. BESTWAY Manufacturer Warranty

2.1 Without prejudice to the statutory legal guarantee and the consumer’s legal rights, and without limiting the consumer’s right to claim the statutory legal guarantee mentioned above, BESTWAY offers an additional manufacturer warranty (“BESTWAY Manufacturer Warranty”) for possible conformity defects for a limited number of products.

2.2 The BESTWAY Manufacturer Warranty only applies to purchases made by a consumer, meaning items purchased by an individual for purposes that are not related to their trade, business, or professional activity. For example, if the product is used by a company for commercial purposes, the BESTWAY Manufacturer Warranty does not apply.

2.3 The manufacturer warranty may be activated by the consumer or the retailer under the conditions listed below.

  9. Hydrium™ pools
  10. Tanx™ pools
  11. Cartridge filter pumps
  12. Skimatic™ 2-in-1 hanging skimmer / filter pump combination
  13. Sand filter systems
  14. Electric pool heaters and heat pumps
  15. Saltwater systems
  16. Solar showers (for purchases until 31.12.2025)
  17. AquaTronix™ pool robots
  18. Safety ladders, only if included in a pool set
  19. Pool covers and ground cloths, only if included in a pool set
  20. Repair kits, only if included in a pool set

b) Duration of the BESTWAY Manufacturer Warranty

The manufacturer warranty for all the above-mentioned BESTWAY products is 24 months from the date indicated on the purchase receipt or tax receipt issued at the time of purchase, unless the legislation of the respective EU member state provides otherwise.

In order to avoid losing the rights granted by the BESTWAY Manufacturer Warranty, a suspected conformity defect must be reported to BESTWAY within 2 months of its discovery, as described in paragraph (c) below.

c) Activation and services of the BESTWAY Manufacturer Warranty

To report a suspected conformity defect and activate the warranty, the consumer or retailer must contact the competent BESTWAY customer service in their country of residence.

The request can be submitted:

The notification must include the following information:

  • Consumer contact details
  • Date of purchase and copy of the purchase or tax receipt
  • Item number
  • Serial number / production date ( Item and serial numbers – Bestway Germany )
  • Description and/or photos and/or video of the defect
  • Photos and/or video of the product installation
  • Any other documentation required by BESTWAY to investigate the case

When activating the BESTWAY Manufacturer Warranty, the consumer is required to provide all relevant information necessary for BESTWAY to evaluate and resolve the issue within a reasonable period of time. If one or more of these conditions are not met, the BESTWAY Manufacturer Warranty will not apply; however, this does not affect the consumer’s statutory legal rights.

If a conformity defect is confirmed, BESTWAY will replace only the defective individual parts, not the entire set.

In some cases, BESTWAY may request that a partial section of the product be cut out and photographed for submission via email in order to proceed with the replacement.

The replacement does not start a new manufacturer warranty period, neither for the replacement part nor for the entire set. Therefore, the BESTWAY Manufacturer Warranty is not interrupted or suspended by the replacement of defective parts and continues until its natural expiration date.

The replacement does not cause any additional costs for the consumer or the retailer from whom the product was purchased, unless otherwise specified in the BESTWAY business terms and conditions which the retailer must read before activating the warranty. Activation of the warranty by the retailer implies acceptance of all conditions of the BESTWAY business terms and conditions in their current version.

d) Limitations of the BESTWAY Manufacturer Warranty

The BESTWAY Manufacturer Warranty exclusively covers conformity defects in products that do not comply with the product specifications. It does not cover problems resulting from various causes including, but not limited to, incorrect installation, improper use, lack of maintenance, improper use of chemicals, incorrect power supply, negligence and/or modification of the product, use of unsuitable and/or non-original accessories, visible damage not reported at the time of delivery, damage caused by weather conditions, defects not caused by manufacturing faults, missing parts reported more than two months after purchase, or purely aesthetic defects that do not affect the functionality of the product (e.g. superficial scratches or material residues).

BESTWAY products are excluded from warranty if they were purchased used or refurbished. The warranty is not transferable to third parties.

The manufacturer warranty does not apply to products that have been opened and/or modified without BESTWAY’s consent (for example, but not limited to opening a pump).

The BESTWAY Manufacturer Warranty does not cover financial losses caused by water or chemical consumption.

The manufacturer warranty does not cover property damage caused by improper installation and/or assembly of the product and failure to follow the instructions in the user manual, such as flooding caused by installing the product on an uneven or unsuitable surface.

No reimbursement can be claimed for repairs and/or replacement parts carried out by the consumer or retailer that were not performed in accordance with the conditions described in the manufacturer warranty terms and conditions.

Due to different safety and/or regulatory standards, installation and/or use of BESTWAY products in countries other than the original country of purchase may lead to personal injury, property damage, and/or damage to the product itself. This may result in the warranty becoming void.

f) Effective date

The warranty applies to all notifications received pursuant to paragraph 2.3 (c) concerning BESTWAY products for which the specific European directive of this document applies.
