Warranty Conditions

Below you will find the warranty terms applied by BESTWAY EUROPE S.p.A.  with registered office in Via della Resistenza n. 5, San Giuliano Milanese (20098) - Milan, Italy (hereafter "BESTWAY"), on products sold within the European Economic Area under the BESTWAY trademark.

 

  1. Legal warranty

 

1.1 The legal warranty is provided by the European Directive 2019/771/EC, which aims to protect the Consumer, as defined below, in the event that the purchased goods (“Products”) have defects of conformity.

 

1.2 Pursuant to the aforementioned European Directive, Consumer is any natural person who purchases a Product for purposes unrelated to his or her business, trade, craft or profession (the "Consumer").

 

1.3 Legal warranty lasts 24 months from the delivery of the goods to the Consumer. Please consider that the terms stipulated in the mentioned Directive do not apply outside the countries within the European Economic Area for which the relevant local legislation applies.

 

1.4 If the Consumer believes that he or she has purchased a Product with a conformity defect, the Consumer must contact his or her Retailer to make use of the related warranty.

 

1.5 Bestway shall provide the warranty, for any possible conformity defect of the Products, to any Consumer who purchased the Products directly from Bestway itself.

 

 

  1. Bestway Manufacturer Warranty

 

2.1 Notwithstanding the legal guarantees and rights, and notwithstanding the consumer's possibility to activate the aforementioned legal warranty, Bestway offers an additional manufacturer warranty ("Bestway’s Manufacturer Warranty”) for possible non-conformities on a limited range of products.

 

2.2. Bestway’s Manufacturer Warranty applies only to purchases made by a consumer, i.e. any item purchased by an individual acting for purposes other than his or her trade, business, or profession. For example, if the Customer is affiliated with a company that uses our Products for commercial purposes, the Product will not be covered by Bestway’s Manufacturer Warranty.

 

2.3 The Manufacturer warranty may be activated by the Consumer of the Product or by the Retailer, under the following terms and conditions.

    2. Lay-Z-Spa® sets with Wi-Fi
    3. Lay-Z-Spa® Ice baths
    4. Fast Set pool sets (from 183 x 51 cm and above)
    5. Steel Pro® pool sets (except 56423, 5618T Splash-in Shade)
    6. Steel Pro Max pool sets
    7. Power Steel pool sets
    8. APX 365 pool sets
    9. Hydrium pool sets
    10. Tanx™ pool sets
    11. Filter Pumps
    12. Skimatic Filter Pumps
    13. Sand Filters
    14. Electrical pool Heaters
    15. Chlorinators
    16. Pool showers (purchased until 31/12/2025)
    17. Cleaning robots AquaTronix
    18. Ladders, only if included in the pool sets
    19. Covers & Ground Cloths, only if included in the pool sets
    20. Maintenance kits, only if included in the pool sets
    21. Hydro Force SUP
    22. Trampolines (from 244 x 220 cm and above)

 

(b) Duration of Bestway Manufacturer warranty

The manufacturer warranty for all Bestway products mentioned above covered by aftersales service is 24 months from the date shown on the receipt or tax document issued at the time of purchase, unless otherwise provided for by the legislation of each Member State of the European Union.

 

To avoid forfeiture of the rights granted by Bestway’s manufacturer warranty, the alleged non-conformity of the Bestway product must be reported to Bestway within 2 months of its occurrence, as described in the following paragraph (c).

 

(c) Activation and Services of Bestway Manufacturer warranty

In order to report an alleged non-conformity of the Product and to activate Bestway Manufacturer Warranty, the Consumer or the Retailer must contact the Customer Service Center located in their Country of residence, provided by Bestway.

 

The claim can be lodged:

  • Via the online form (www.bestwayservice.de)

 

Communication must include the following details:

  • consumer contact details;
  • date of purchase and copy of the ticket receipt or tax document;
  • item number;
  • serial Number/production number (Artikel- und Seriennummern – Bestway Deutschland GmbH);
  • description and/or pictures and/or video of the defect;
  • pictures and/or video of the installation of the product;
  • Any other documentation that Bestway may need to investigate the claim.

 

Upon activation of the Bestway Manufacturer Warranty, the Consumer is required to provide Bestway with all the information that is relevant to the case, which is critical to ensure that Bestway is able to assess and remedy the problem within a reasonable timeframe. If one or more of these conditions are not met, Bestway Manufacturer Warranty will not apply; however, this does not affect the Consumer’s right to rely on the legal warranty.

 

In the event that a non-conformity defect of the Product is detected, Bestway will replace only the defective part and not the whole set.

In some cases, Bestway may request the partial cut out of the product, to be sent by e-mail in order to proceed with the replacement.

The replacement will not entail the start of a new Manufacturer Warranty period, neither for the spare part nor for the whole set; therefore, Bestway Manufacturer Warranty will not be interrupted and/or suspended in any way by the replacement of the defective parts and will resume its natural expiry date.

 

The replacement will not entail any additional costs neither for the Consumer, nor for the Retailer from whom the Consumer purchased the product, unless otherwise stated in the Trade Policy, which the Retailer must read before activating Bestway Manufacturer Warranty. Activation of the warranty by the Retailer implies acceptance of all the terms and conditions of the Bestway Commercial Policy in its latest version.

 

(d) Limits to the application of Bestway Manufacturer warranty

Bestway Manufacturer Warranty covers only defects in Bestway products that do not conform to the specifications. On the other hand, it does not cover, in any way whatsoever, problems due to various causes, such as, by way of example and not limited to, those potentially resulting from incorrect installation, incorrect use, lack of maintenance, poor management, incorrect use of chemicals, incorrect power supply, neglect or improper handling and/or modification of the Bestway Product and/or use of inappropriate and/or non-original accessories and/or parts, damage visible from the outside and not disputed at the time of delivery, damage caused by weather conditions, any defect that is not due to a manufacturing problem, reports of missing parts made more than two months after the date of purchase, defects of a purely aesthetic nature that do not impair the product’s functionality (such as superficial scratches or residual material). 

 

Bestway Products are not covered by Bestway’s Manufacturer Warranty when purchased used and/or refurbished. Furthermore, warranties cannot be transferred to third parties.

 

Bestway Manufacturer Warranty does not cover products that have been opened and/or tampered with, without Bestway's consent (for example, but not limited to, opening a pump).

 

Bestway Manufacturer Warranty does not cover any economic losses due to water and chemical consumption costs.

 

Bestway Manufacturer Warranty does not cover damage to property caused by improper installation and/or assembly of the Product according to the instructions in the User Manual; for example, damage caused by flooding due to installing the Product on a surface that is uneven and/or unsuitable.

 

No refund can be claimed for repairs to the product and/or replacements of its parts made by the consumer or the reseller in any manner other than that described in the terms & conditions set out in the Manufacturer Warranty itself.

 

Due to differing safety and/or regulatory standards, which may vary from Country to Country, Bestway informs the Consumer that the installation and/or use of Bestway Products in a Country, other than the one where the Products were purchased, may result in injury to persons and/or property and/or damages to the Product itself (or any part thereof). Failure to comply with the requirements set forth herein may void Bestway’s Manufacturer Warranty.

 

(f) Effective date

Bestway Warranty shall apply with reference to all notifications received as per paragraph 2.3 (c) in relation to Bestway Products applying the specific European Directive of this document.
