Warranty Conditions

Below you will find the warranty conditions applied by BESTWAY EUROPE S.p.A., located at Via della Resistenza No. 5, San Giuliano Milanese (20098) – Milan, Italy (hereinafter referred to as "BESTWAY") for products sold under the BESTWAY brand within the European Economic Area.

  1. Statutory Warranty

1.1 The statutory warranty is granted by the European Directives 1999/44/EC and 2019/771/EU, which aim to protect the consumer, as defined below, in the event that the purchased goods ("products") exhibit a lack of conformity.

  • European Directive 1999/44/EC for all goods purchased until December 31, 2021
  • European Directive 2019/771/EU for all goods purchased on or after January 1, 2022

1.2 According to the aforementioned European Directives, a consumer is any natural person who purchases a product for purposes not related to their trade, business, craft, or profession ("consumer").

1.3 The statutory warranty period is 24 months from the delivery of the goods to the consumer, unless otherwise provided by the laws of the respective member state of the European Union.

1.4 If the consumer believes they have purchased a product with a lack of conformity, they must contact their retailer to claim the appropriate warranty.

1.5 BESTWAY assumes warranty responsibility for any lack of conformity of the products for any consumer who purchased the products directly from BESTWAY.

  1. BESTWAY Manufacturer's Warranty

2.1 Without prejudice to the statutory warranties and legal rights provided by law, and the consumer’s right to claim the above-mentioned statutory warranty, BESTWAY offers an additional warranty ("BESTWAY Manufacturer’s Warranty") for a limited number of products for possible defects in conformity.

2.2 The BESTWAY Manufacturer’s Warranty applies only to purchases made by a consumer, i.e. items purchased by an individual for purposes not related to their commercial, business, or professional activities. For example, if the product is used by a company for commercial purposes, the BESTWAY Manufacturer’s Warranty does not apply.

2.3 The manufacturer's warranty can be activated by the consumer or the retailer under the conditions listed below.

(b) Duration of the BESTWAY Manufacturer’s Warranty

The manufacturer’s warranty for all products listed above is 24 months – unless otherwise stipulated by the legislation of the respective European Union member state – from the date stated on the receipt or tax document issued at the time of purchase.

To avoid losing the right to claim, a suspected defect must be reported to BESTWAY within 2 months of its occurrence, as described in section 2.3 (c).

(c) Activation and Services of the BESTWAY Manufacturer’s Warranty

To report a suspected defect and activate the warranty, the consumer or retailer must contact the appropriate BESTWAY service center in their country of residence.

The claim can be submitted:

The notification must include the following information:

  • Consumer's contact information
  • Purchase date and copy of receipt or invoice
  • Item number
  • Serial number
  • Description and/or images and/or video of the defect
  • Images and/or video of the product installation
  • Any other documents BESTWAY needs to examine the case

After warranty activation, the consumer is required to provide all of the above information so that BESTWAY can review and process the case within a reasonable timeframe.

If these requirements are not met, the warranty is void. However, the consumer can still rely on the statutory warranty as described in section 1.

If a defect is confirmed, BESTWAY will replace only the defective parts, not the entire set. A new warranty period does not begin – neither for the spare part nor for the entire system. The exchange does not interrupt or extend the warranty period.

The replacement is free of charge for the consumer.

There are no costs for the retailer unless otherwise stated in the current BESTWAY terms and conditions. Activating the manufacturer's warranty implies acceptance of these conditions by the retailer.

(d) Limitations of the BESTWAY Manufacturer’s Warranty

The warranty covers only defects in conformity. It does not cover damage caused by the following:

  • Incorrect installation or improper use
  • Insufficient or incorrect maintenance
  • Misuse of chemicals or incorrect power supply
  • Negligence, tampering, or modification of the product
  • Use of unsuitable or non-original accessories or spare parts
  • Visible damage that was not reported upon delivery
  • Weather-related damage
  • Defects not attributable to production errors
  • Missing parts reported more than two months after purchase

Products are excluded from warranty if purchased second-hand or refurbished. The warranty is not transferable to third parties.

It becomes void if the product is opened or tampered with without BESTWAY’s approval (e.g., pumps).

The warranty does not cover financial losses due to water or chemical usage.

Damage caused by incorrect installation on unsuitable surfaces or by failure to follow the user manual is also excluded.

BESTWAY is not liable for services or replacements outside the official warranty process.

Using the products in countries other than the original country of purchase may lead to risks or damage – this may void the warranty.

(e) Effective Date

The warranty applies to all claims under section 2.3 (c) that concern products subject to the European directive mentioned in article 1.1.
